1About SamuiJobs

SamuiJobs is operated by NORDENFELD CO., LTD., a company registered under the laws of the Kingdom of Thailand (Company Registration Number 0845566013565). Our registered office is at 14/102 Moo 2, Bo Phut, Koh Samui, Surat Thani 84320, Thailand.

We provide a candidate sourcing and delivery service for businesses in Koh Samui, Thailand and surrounding regions.

2Definitions

• "Employer" or "you" means the business or individual purchasing a Package.
• "Candidate" means an individual sourced and pre-qualified by SamuiJobs in response to your job brief.
• "Package" means a paid plan (Starter, Standard, or Pro) entitling the Employer to a defined number of pre-qualified Candidates.
• "Delivery" means forwarding a pre-qualified Candidate's contact details to the Employer, typically via the Employer's LINE messaging account.
• "Pre-qualified" means a Candidate who, based on our internal screening process, has indicated availability, suitability, and willingness to apply for the Employer's role at the time of Delivery.

3The Service

When you purchase a Package, SamuiJobs will (a) source candidates relevant to your job brief, (b) pre-qualify them through our internal screening process, and (c) deliver qualified candidates' contact details to you within the timeframe specified.

Packages available:

• Starter — ฿3,000 — up to 5 Candidates
• Standard — ฿5,000 — up to 10 Candidates
• Pro — ฿8,000 — up to 20 Candidates

All prices are stated in Thai Baht (THB).

4What the Service Is Not

SamuiJobs is not (a) a recruitment or staffing agency, (b) a job board or job listing platform, (c) an employer of any Candidate, or (d) a party to any employment agreement between you and a Candidate.

We source and pre-qualify Candidates. We do not conduct formal background checks, verify employment history or qualifications, or guarantee a Candidate's conduct or performance after Delivery. You are solely responsible for interviewing, vetting, hiring, employing, and managing any Candidate.

5Pricing and Payment

• Upfront payment. All Packages are paid in full upfront. We do not offer pay-on-hire or post-payment terms.
• Payment processor. Payments are processed by Stripe, Inc. By paying, you also agree to Stripe's terms of service.
• Accepted methods. Credit/debit cards (Visa, Mastercard), Apple Pay, Google Pay, and PromptPay.
• All Package prices are inclusive of Thai Value-Added Tax (VAT) at 7%.
• Tax invoices are issued by NORDENFELD CO., LTD. on request.
• No subscription. Each Package is a one-time purchase. To hire again, purchase another Package.

6The 7-Day Guarantee and Refunds

We guarantee that within 7 calendar days of purchase, you will receive Delivery of pre-qualified Candidates as described in your Package.

If we have not delivered any pre-qualified Candidates within 7 calendar days, you are entitled to a full refund of your Package payment. If we deliver some but not all Candidates within 7 days, the refund is calculated on a pro-rata basis for the undelivered portion.

The following circumstances do not trigger a refund:

• A Candidate declining to proceed after initial Delivery.
• A Candidate failing the Employer's interview, trial, or background expectations.
• The Employer not responding to delivered Candidates within a reasonable time.
• The Employer changing job requirements after submission.

Refunds are issued through Stripe to the original payment method within 7 business days of the refund request being approved. Once an Employer has hired a Candidate from a Package, no further refunds or replacements are available for that Package.

7Your Obligations

• Provide accurate, complete, and current information about the role, including salary, location, schedule, and start date.
• Respond to delivered Candidates within a reasonable time (typically within 48 hours of Delivery).
• Treat Candidates with respect and in compliance with Thai labour laws.
• Not discriminate against Candidates on the basis of race, religion, gender, age, nationality, sexual orientation, disability, or any other protected characteristic, except where a bona fide occupational requirement permits.
• Keep Candidate personal information confidential and use it only for the purpose of evaluating and potentially hiring the Candidate.
• Comply with Thailand's Personal Data Protection Act B.E. 2562 (2019) ("PDPA") and all applicable employment laws when handling Candidate data and employment matters.
• Not resell, share, or transfer Candidate contact details to any third party.
• Pay all agreed wages, taxes, social security, and other employer obligations directly to any Candidate you hire.

8Candidate Data and Confidentiality

Pre-qualified Candidate contact details are provided to you for the sole purpose of evaluating and potentially hiring them for the specific role you submitted. You must not (a) use the data for any other role or future hiring without explicit Candidate consent, (b) add Candidates to mailing lists or marketing databases, (c) share Candidate details with any other person or business, or (d) retain Candidate data longer than necessary for the immediate hiring purpose.

Failure to comply may constitute a breach of PDPA and result in immediate termination of your account, without refund, in addition to any legal remedies available to us or to the affected Candidate.

9Intellectual Property

All content, branding, software, design, and underlying systems on samui.jobs are owned by NORDENFELD CO., LTD. and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

When you submit a job brief, you grant SamuiJobs a non-exclusive, worldwide, royalty-free licence to use that content for the purpose of sourcing and pre-qualifying Candidates for your role.

10Limitations of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by Thai law, we make no warranty that the Service will be uninterrupted, error-free, or meet specific business outcomes beyond the 7-Day Guarantee in Section 6.

We are not liable for: a Candidate's conduct, performance, attendance, or fitness for the role after Delivery; any employment dispute between Employer and Candidate; any direct, indirect, incidental, or consequential damages arising from your use of the Service.

Our total maximum liability to you, for any claim arising from the Service, is limited to the amount you paid for your most recent Package.

11Indemnification

You agree to indemnify and hold harmless NORDENFELD CO., LTD., its directors, officers, employees, and partners from any claims, damages, or expenses (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your employment of any Candidate, or (c) your violation of any law or third-party right.

12Termination

We may suspend or terminate your access to the Service if you breach these Terms, misuse Candidate data, or engage in fraudulent or abusive activity. Termination for cause does not entitle you to a refund.

You may stop using the Service at any time. Payment for already-purchased Packages remains subject to the refund terms in Section 6.

13Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with PDPA. By using the Service you also agree to the Privacy Policy.

14Modifications to These Terms

We may update these Terms from time to time. Material changes will be notified by posting the updated Terms on the Site with a new "Last Updated" date. Continued use of the Service after changes constitutes acceptance.

15Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand, without regard to its conflict-of-law principles.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved by good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Surat Thani Province, Thailand.
